Service Description:
- Undertake the collection of overdue rent for the plaza
- Provide collection progress reports and recovery rate analysis
- Support legal recovery procedures
- Manage payments and provide reports
- Apply for a court order for wage garnishment
- File a civil lawsuit
- Apply for a court order to garnish a bank account
- Apply for a lien on the debtor’s real property
Responsibilities of the Collection Attorney :
- The collection attorney must comply with all applicable federal and Hawaii state laws,
including the Fair Debt Collection Practices Act (FDCPA). - The agency shall begin collection actions within the specified timeframe after receiving
account data and provide regular updates. - Monthly reports should include results of tenant contacts, recovered amounts, outstanding
accounts, and next-step recommendations. - All funds collected shall be remitted within the agreed timeframe with full transaction
details. - For unresolved accounts, the attorney shall provide legal recommendations and assist with
courts. - Any tenant complaints or disputes must be promptly reported with complete records.
- The attorney must maintain strict confidentiality of all tenant and account information.
